Terms of Use
These Terms of Use govern your use of ordavohealth.com (the "Site"), operated by Ordavo Health LLC ("Ordavo," "we," "us"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
Note: access to the Ordavo software application is governed by a separate Software Service Agreement and Business Associate Agreement, not by these Terms.
1. Use of the Site
You may use the Site for lawful purposes only. You agree not to:
- Use the Site in any way that violates applicable law
- Attempt to gain unauthorized access to any portion of the Site or our systems
- Introduce malware or interfere with the operation or security of the Site
- Use automated means to scrape or harvest content or contact information
- Misrepresent your identity or affiliation when contacting us
2. Intellectual Property
The Site and its contents, including text, design, graphics, the Ordavo name, and the Ordavo logo, are owned by Ordavo and protected by intellectual property law. You may view and print pages for your own business evaluation. You may not reproduce, distribute, or create derivative works without our written permission.
3. Informational Purposes Only
3.1 Content on the Site is provided for general informational purposes about our software.
3.2 Not medical advice. Nothing on the Site is medical, clinical, or coding advice. Ordavo does not practice medicine and does not evaluate the medical necessity or correctness of any order.
3.3 Not legal or compliance advice. Statements on the Site regarding electronic signatures, Medicare requirements, or HIPAA are general information, not legal advice. Each agency remains responsible for its own regulatory compliance and should consult its own counsel.
3.4 Descriptions of results, time savings, and cost figures are estimates and illustrations based on general industry information. They are not guarantees. Actual results vary by agency, physician, and workflow.
4. Submissions
If you submit information through a form on the Site, you represent that the information is accurate and that you are authorized to provide it. Do not submit patient information or any protected health information through the Site. Our contact forms are not a secure channel for health information.
5. Third-Party Links
The Site may link to third-party sites. We do not control and are not responsible for their content, products, or privacy practices.
6. Disclaimer of Warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORDAVO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
8. Indemnification
You agree to indemnify and hold harmless Ordavo from any claim arising out of your use of the Site or your violation of these Terms.
9. Changes
We may modify these Terms at any time. Changes take effect when posted with an updated Effective Date. Your continued use constitutes acceptance.
10. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Venue lies in Travis County, Texas.
